Event | Avoiding Corruption – Legislative Updates for Australian Businesses

On Monday 10th September, AustCham will host an event with David Tonkin, Chief Counsel for the Australian Trade and Investment Commission (Austrade). This presentation will cover changes to Australian laws and added obligations under the Combatting Corporate Crime Bill currently before the Australian Parliament. Mr Tonkin will brief the AustCham community on the expansion of foreign bribery offences; what ‘adequate procedures’ must be taken to avoid new laws around an entity ‘failing to prevent’ foreign bribery, the current status of the facilitation payments defence, a proposed deferred prosecution scheme and debarment framework.
Discussion will also draw on comparative laws in US and UK legislation as a guide to what may be expected by Australian prosecutors. This is an opportunity to gain insight into the evolving laws that will impact business.
The event will be followed by a Q&A with opportunities for networking and drinks.
Guest Speaker: David Tonkin
David has been Legal Counsel for Austrade for the last 23 years and in that time provided advice and represented Austrade in a number of major cases involving bribery and fraud in trade.
Since 2011, David has developed and rolled out anti-bribery training for Austrade staff throughout its 81 offices in 48 countries and designed an outreach program for business, from insights gained from working with the AFP and Commonwealth agencies in live foreign bribery cases.
He understands current issues impacting exporters seeking to trade in low governance/high risk markets, managing local agents and navigating the pitfalls of Australian extraterritorial legislation regarding bribery of foreign public officials. He has represented Austrade at the OECD and consulted in proposed changes to Australian law that will impose serious new obligations on Australian Business working off-shore.
David Tonkin earnt degrees in Law and Commerce from the University of Melbourne and prior to joining Austrade was a partner of a law firm working in Melbourne and later started a legal research business in Los Angeles.
He lives in Sydney with his wife and 4 children.
